CareQR - Terms & Conditions

Welcome to CareQR, a service owned and operated by RemoteKonnect ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of the CareQR website, platform, and emergency QR services ("Services"). By accessing or using careqrcode.com, you agree to be bound by these Terms.

If you do not agree with these Terms, you must stop using the Services immediately.

1. Eligibility

You may use CareQR only if:

• You are at least 18 years old; or
• You are a parent, guardian, organisation, or service provider authorised to create and manage profiles on behalf of another individual.

You are responsible for ensuring you have appropriate consent from any person whose information you enter into the Service.

2. Description of Service

CareQR enables users to:

• Create emergency profiles with medical details, conditions, medications, allergies, and instructions.
• Generate QR codes that display essential emergency information when scanned.
• Share selected information publicly with first responders via a web page.
• Manage profiles through an online dashboard (depending on subscription level).

CareQR is a support tool only. It does not provide medical advice, diagnosis, or treatment, and it does not guarantee any emergency response.

3. Subscriptions, Billing & Payments

CareQR offers monthly and yearly subscription plans. Payments are processed securely through Stripe.

3.1 Billing

• Subscription fees are charged in AUD unless otherwise stated.
• Subscriptions renew automatically at the end of each billing period.
• You authorise us and our payment processor to charge your chosen payment method.

3.2 Refunds

Subscription fees are generally non-refundable, except where required by Australian Consumer Law or other applicable legislation.

3.3 Cancellation

• You may cancel your subscription at any time via your account or billing portal.
• Your access will remain active until the end of the current billing period.

4. User Responsibilities

You agree that you will not:

• Provide false, misleading, or incomplete medical or contact information.
• Upload information you are not authorised to share.
• Use the Services for unlawful, harmful, or abusive purposes.

You are responsible for maintaining the accuracy of any emergency data, and for updating your profiles when health circumstances change.

5. Emergency Use Disclaimer

CareQR is designed to make key information more accessible in emergencies. However, we do not:

• Guarantee that first responders or bystanders will scan or access your QR code.
• Guarantee the availability of internet, networks, or third-party services.
• Control how others interpret, act on, or respond to the information shown.

6. Privacy & Data Handling

Our handling of personal information is described in our Privacy Policy. By using CareQR, you agree that we may collect and use your information in accordance with that policy.

7. Service Availability

We may modify, suspend, or discontinue the Services at any time, with or without notice, for maintenance, security, or operational reasons.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, except to the extent such warranties cannot be excluded under applicable law (including the Australian Consumer Law). To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Services will be uninterrupted, timely, secure, or error-free.

9. Data Backup & Loss

You are solely responsible for maintaining your own independent copies of any information you enter into CareQR, including medical, emergency, and profile data. While we take reasonable steps to protect data stored on the platform, we do not guarantee backups and are not liable for any loss, corruption, deletion, or unavailability of data, however caused, including data needed for emergency use.

10. Limitation of Liability

To the fullest extent permitted by law, RemoteKonnect and its directors, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising from or relating to your use of, or inability to use, the Services, including any injury, harm, or loss related to emergency situations or reliance on displayed information.

To the extent liability cannot be excluded, our aggregate liability arising out of or relating to these Terms or the Services is limited to the total fees you paid to us in the 12 months preceding the event giving rise to the claim, or AUD $100 if you have not paid any fees.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or other applicable legislation. Where our liability for failing to meet a consumer guarantee cannot be excluded but may be limited, our liability is limited, at our option, to re-supplying the Services or paying the cost of having the Services re-supplied.

11. Indemnification

You agree to indemnify and hold harmless RemoteKonnect and its directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Services, your breach of these Terms, or information you submit, including information you submit on behalf of another individual.

12. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, internet or telecommunications failures, power outages, or failures of third-party providers or infrastructure.

13. Suspension & Termination

We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have breached these Terms, failed to pay applicable fees, or misused the Services. On termination, your right to use the Services ends immediately; data handling on termination is described in our Privacy Policy.

14. Intellectual Property

All content, trademarks, logos, designs, and software associated with CareQR and careqrcode.com are the property of RemoteKonnect or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

15. Governing Law

These Terms are governed by the laws of Australia. You agree to submit to the exclusive jurisdiction of the courts located in Australia in relation to any dispute arising out of or relating to these Terms or your use of the Services.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and RemoteKonnect regarding the Services.
